OBOT Licensure Requirements Are Now In Effect

Published: Jan 16, 2018 by Levi Tkach

On November 13, 2017, the State of Ohio Board of Pharmacy authorized its Executive Director to extend the deadline for obtaining a license as a Terminal Distributor of Dangerous Drugs (TDDD) with an Office-Based Opioid Treatment Classification (OBOT) to January 15, 2018. This extension was only valid if the facility had applied for an OBOT license by November 30, 2017.

This deadline has come and gone.

However, some OBOT clinics have received written notification from the Pharmacy Board informing them they may continue to operate as an OBOT clinic pending final review of their timely submitted OBOT applications.

At this time, no facilities may prescribe controlled substances to treat more than thirty patients for opioid dependence without first obtaining a license as a TDDD with an OBOT Classification. Failure to obtain a TDDD with an OBOT Classification can result in a $5,000 fine for each day of non-compliant operation. As of today, only a written extension from the Pharmacy Board or a qualifying exemption can protect you from this requirement.

If you are a health care professional regulated by the Pharmacy Board and you have questions regarding OBOT licensure requirements, you should consider contacting an Ohio pharmacy license defense attorney at Graff & McGovern, LPA, for a no-cost consultation.
