What is the New Plastic Pipe Mandate Legislation in Ohio?

For a third legislative session, Rep. Jay Edwards (R, Nelsonville) is set to introduce legislation that mandates design professionals to specify all materials for water.

The legislation is supported by the Chemical Council in an effort to prevent professional engineers from specifying materials to the exclusion of plastic, or PVC piping for water.

Any project funded in whole or in part with state money would be affected. This removes design discretion, shifting the burden to the designer to justify not using any material. Thus, OSU vertical buildings or ODOT waste water projects might be prevented from specifying a single, appropriate piping product.

Opponents are concerned that once the legislature specifies one material, other specification restrictions might follow.
